When an employee raises a complaint of harassment, discrimination, retaliation, or other workplace misconduct, the employer has both a legal obligation and a practical interest in responding promptly and thoroughly. How that investigation is conducted, and by whom, can make a significant difference in the outcome.
At the Law Office of Catherine Chukwueke, I conduct independent workplace investigations for California employers that are impartial, thorough, and built to withstand legal scrutiny.
Why an External Investigator?
When a complaint involves a manager, a senior employee, or a situation with significant legal exposure, having an external investigator matters. An internal HR team, however skilled, is not positioned to provide the same level of independence. An external attorney investigator brings objectivity, legal expertise, and credibility that strengthens both the integrity of the process and the defensibility of any actions taken as a result.
What the Investigation Process Involves
- Initial scoping to determine the appropriate scope and approach
- Interviewing the complainant, the respondent, and relevant witnesses
- Gathering and reviewing documentary evidence
- Assessing credibility and reaching findings supported by the evidence
- Delivering a written report outlining the findings and recommendations
Throughout the process, confidentiality is maintained to the extent possible, and all parties are treated with professionalism and discretion.
What Employers Should Know
California courts and agencies take seriously the adequacy of an employer's response to workplace complaints. Failing to investigate promptly and thoroughly, or conducting an investigation that appears biased or incomplete, can itself be used as evidence against the employer. A well-documented, independent investigation demonstrates that you took the matter seriously and followed a fair process.
